Kasanda Dissappears and court is waiting for him.

Kasanda disappeared

BUSINESSMAN Shaderick Kasanda has been arrested by law enforcement agencies in connection with fresh charges to be imposed on him.

This came to light this afternoon when the case involving Kasanda and 10 others was called before the Lusaka Magistrate’s Court.

Mr Kasanda and 10 others are charged with Espionage and are appearing before Lusaka chief resident magistrate Davies Chibwili.

But when the case was called, State advocate Gracilia Mulenga informed the court that all the accused were in court apart from Mr Kasanda who had just been arrested.

“I did receive a call and I have just been informed that the sixth accused person has been picked up by the law enforcement agencies. I am yet to get full details on some other charges,” Ms Mulenga said.

Defence lawyer Makebi Zulu then asked the person who arrested his client be cited for contempt of court.

“In our view, that is contemptuous of this court because there was an order that all the accaued should be before you.

“The law enforcement agencies cannot defy that order especially that they are fully aware that the accaued was to be before you. The prudent thing would have been to wait for these proceedings to take off and there after carry on with their work. In the absence of accused six, these proceedings can’t continue.,” Mr Zulu said.

Magistrate Chibwili said if contempt of court proceedings were to be instituted, a person who is supposed to be cited needs to be known.

The court has since adjourned the case briefly for 15minutes.

Her death has thrown many of her peers in grieving shock.

For some, that Angela was even seen online on Social media moments before her death makes her demise even more painful.

Family and friends of Angela have described her as a kind, calm, collected, jovial and a friend whose loyalty knew no boundaries.

“ So you’ve forgotten about our plans we talked about yesterday of applying for employment under government health recruitment aii ? Three years of hard work at Makeni school of nursing has just gone in vain ? Sindine mwana wanyoko to be arresting me while sick

Edith nawakwi arrest

Sindine mwana wanyoko to be arresting me while sick, msssh! – Nawakwi

Sindine mwana wanyoko for you to infringe on my rights msssh! says FDD leader Edith Nawakwi.

And Nawakwi has charged that instead of concentrating on the gold mafias who have made their way to the “State House kitchen” and addressing the record high mealie meal prices, President Hakainde Hichilema is more determined to wash his “Pheruna dirt” on her.

But police have urged Nawakwi to report herself to the police, expressing surprise that the person said to be sick is spreading messages that police is looking for her.

Speaking with Daily Revelation, Nawakwi said police went to her home in Roma to arrest her this morning but they couldn’t as she was receiving treatment at the hospital.

“They have left. They say they want to arrest me on the warn and caution statement they recently recorded against me, that’s the statement from my lawyer. They are doing this in the presence of the letter from UTH that I’m on continuous medical treatment. Even then they told the lawyer that bring her we arrest her. They are aware that I am indisposed and was out for three months,” Nawakwi said. “Surely, I couldn’t have gone for manicure or for honeymoon. I have a family and I am a leader of a political party. They say I am a fugitive as their Mr Koswe says. They are just disturbing my healing.”

Nawakwi insisted that the Hatembo issue must be blamed on President Hichilema and the people in the UPND, including his permanent secretary…

The Gold Scandal:Is State House the Command Centre?

Fred M’membe

Yesterday, Mr Francis Mateyo, a State House security officer, appeared in the Lusaka Magistrate’s Court alongside other accused persons in the gold gate scandal.

Mr Mateyo is part of the UPND cadres, who were encrypted into the State House security after Mr Hakainde Hichilema took over office as Head of State. Mr Mateyo is believed to be a loyalist and a very close, very trusted and strong ally of the Mr Hichilema, right from his days as an opposition leader.

When we first picked up intelligence about the gold gate scandal at KKIA and the alleged involvement of Mr Mateyo, one of Mr Hichilema’s trusted security officers at State House, we immediately raised alarm and advised that it was vital for Mr Hichilema to control the evil, disgraceful and morally objectionable activities being peddled by certain identifiable individuals within State House.

Regrettably, our well- intentioned counsel was met with the habitual vicious and malicious attack against us. Even the government officially rubbished the alarm we had raised and called a bluff against us. We were denounced, insulted and slandered by Mr Hichilema’s State House controlled rogue or guerrilla media channels – Koswe and Zambia Watchdog.

Our offence was simple: we exposed what had become a very serious and real crime involving one of their own. It’s clear they never wanted the truth about what happened at KKIA to be known. They were determined to put a lid on it and pretend like nothing happened! This explains why even Mr Mateyo’s capture was hidden from the public until yesterday when he was aligned before the courts. The DEC and other law enforcement agencies went to town posturing and parading all other suspects with an exception of Mr Mateyo, why?

The question is: why have things been handled this way? Did they think the gold gate scandal was going to remain hidden from the public? What was the purpose of that arrogance, insults and hostility towards us? With all that has been offloaded so far and many questions still hovering around Mr Hichilema over this scandal: how will the Zambian people believe that justice will be served in this matter and the real culprits brought to book?

And now that it’s obvious that they’re trapped and embarrassed about the way things have turned out; the only word left for Mr Hichilema and his praise singers at this moment is: “You’re on your own”.

But hang on! Not so fast. What has changed? It’s people like Mr Mateyo we cautioned Mr Hichilema about. It’s these same people they sat, drunk and ate with, not so long ago. No wonder, they were so relentless in trying to defend, insult and threaten those who dared to speak the truth about the gold gate scandal. But now that things have gone sour and getting worse rapidly, they shamelessly want to wash their hands off their man.

Clearly, those linked or are close to Mr Hichilema can only be “on their own” once caught, if not caught, they remain trusted and loyal companions of Mr Hichilema and his league. What a mistake? What hypocrisy? What kind of corrupt leadership is this?

Now they are ashamed because one of them has been mentioned in this mess. They are ashamed and speechless because they too have been caught in their own lies, denials, deception and manipulation.

We have not forgotten how haphazard press briefings were called and all manner of lies and theories were made to defend and justify the gold gate scandal, and distance State House from it. Within hours of the scandal blowing up, we saw how the Minister of Mines, Mr Paul Kabuswe became a mineral expert and talked down on all critical voices, including myself with grandiosity and contempt. Similarly, we saw how the Minister of Home Affairs and Internal Security, Mr Jack Mwiimbu warned politicians against scandalizing the Presidency and State House over the gold gate scandal.

So, now that the dirty is out, what has Mr Hichilema, Mr Mwiimbu and Mr Kabuswe got to say about the gold gate scandal? Mr Kabuswe called us foolish. But we ask the same question he asked us during his press briefing at that time: who is looking foolish now?

Well, we have been vindicated. We said it that there was way too much filth and scum in State House. We warned Mr Hichilema but they responded with the usual malice and insults. As the Tongas say: “Yabeja makani baasa”, and the Bembas also say: “Ifyakulya ubushiku fitulila ku malushi”.

But where does this end? Who else is involved? How many “Mateyos” is Mr Hichilema still working with State House today? How deeply involved is State house in this scandal?

That said, we hope Mr Hichilema is treating the Anti-corruption Commission’s US $500,000 bribe investigation against his Solicitor General, and trusted lieutenant and ally, Mr Marshal Muchende, who stands accused of running a bribery scheme, with objectivity and urgency, or else, a similar outcome awaits him.

Pastor Jimmy Kay Beaten Jobless Men

Pastor Jimmy Kay beaten!

Pastor rJimmy Kumwenda, widely known as Jimmy Kay yesterday found himself at the receiving end of a painful mob beating that reduced his classy outfit to mare pieces of cloth hanging on his body.

The violent free-for-all beating erupted on Lusaka's Buyantanshi Road in Emmasdale area around 08:00 hours yesterday.

According to witnesses, trouble began when Pastor Jimmy Kay's BMW failed to maneuver past a truck that had blocked the road as he drove out of the Zambian Breweries premises.

After hooting several times, the irritated pastor who seemed to be in a hurry stepped out to ask the truck driver to create some room for his posch automobile.

But when 'Real Talk with Jimmy Kay' failed to achieve the intended result, the pastor took matters into his own bare knuckles and delivered a Mike Tyson-kind of jab to the stubborn cheeks of the driver and immediately rendered him unconscious.

Upon seeing what happened, a nearby crowd of jobless young men that gathered near Nyati Milling hoping to chance some piece work seemed to have found some work to do - to exorcise the unwelcomed demons of violence out of the man of God.

While good Samaritans rushed the knocked out driver to a health facility, the crowd, descended on the helpless Pastor Jimmy Kay as if to offload the frustrations of joblessness handed him the mother of all capital city beatings.

It took the bravery of security guards in the vicinity who threw themselves in the melee and wrestled Pastor Jimmy Kay from the crowd and hid him in the safety of their guardroom.

But the damage had already been done as Pastor Jimmy Kay had already lost his designer jacket and his shirt,  punches had shredded his shirt to pieces leaving the tie hanging to his bare neck.

After an hour in asylum, Pastor Jimmy Kay was taken to Matero Police Station where he was detained for assault.

By press time, Zambia Police Service deputy spokesperson Danny Mwale was yet to receive a report on the matter.

AKA's killers Found By Kwazulu Police in South Africa

Aka killers found KwaZulu police

The suspects who shot and killed rapper Kiernan “AKA” Forbes and his friend, prominent chef Tebello “Tibz” Motsoane, have been identified, KwaZulu-Natal police said.

KwaZulu-Natal Police Commissioner, Nhanhla Mkhwanazi said a crack team of investigators are building a solid case before they make arrests.

“So when we end up in court on the day ... we're going to have a very lengthy court case,” Mkhwanazi said.

“Do we want to go to court tomorrow with a half baked case? No.”

He said that the list of suspects also continued to grow and some of them were in jail for other crimes.

Forbes and Motsoane were assassinated in February outside the Wish restaurant on Durban’s Florida Road.

Speaking to news channel eNCA Mkhwanazi said that investigators had painstakingly analysed all the phone calls that were made in the area where Forbes and Motsoane were killed and built a picture of who was making them and who they were communicating with.

In addition, Mkhwanazi revealed that:

– Police have identified the shooters.

– Police have the murder weapon.

– Police have the getaway car.

“I think we've downloaded over 25 phones that we've collected that we've been analysing since then. That much data that we received,” he told the broadcaster.

“There are volumes and volumes of video clips that we've been watching that we've been dealing with throughout the investigation, and we have been able to even see the things that we did not pay attention at the time.”

Mkhwanazi said that the team of investigators comprising some of the most seasoned officers in the province pored over hours and hours of CCTV video which they used to link potential suspects and the phones they were using to communicate with each other.

“And then we start picking up something and we go back to the footage again and say but this is number that was communicating this, but who was using this number and we go back to the footage and we say this person who was standing there was the one who was communicating and then we identify who this person is,” he said in the interview.

From there police were able to further flesh out the case.

“And then we start making approaches. There would be vehicles around, so many vehicles were driving before, during and after (the incident). Some innocently so, you know, up and down the street, parking, and as we investigate,” he said.

“We start getting information about some vehicles that were part of the crime that were already there before the arrival of (Forbes) and we start profiling those cars.”

Investigators then honed in on the owners of the cars and started “going after those individuals”, the provincial commissioner said.

He said that the team assigned to investigate the murders have been working non-stop, and that he had to give them extra computers because the information and data they had gathered to store evidence were so extensive that they had run out storage capacity.

Asked when the matter would be brought before the courts, Mkhwanazi said: “Well, we can go tomorrow. But do we want to go to court tomorrow with a half baked case?

“No. We don't want to go to court because of the few arrests that we’ve effected. Now we will just leave them and say you know what, we'll take someone and charge that person for another crime and keep him in custody, but we know that he is part of this case that we are investigating.”

Mkhwanazi said that when the police do eventually do a take down of the suspects involved in Forbes’ murder, they want to round all the suspects up together.

“So that we can say here is the shooter, here is the organiser and here is the person who ordered the hit and we have all of them,” he said.

Mkhwanazi also revealed that they had already identified the shooters.

“And we are still uncovering some of the people that are part of it. Spotters that were there, because there's quite a few of them that were there. We've identified quite a few already,” he said speaking to eNCA.

“But arresting them is not something that we're interested in doing because they're going nowhere. They're still within the Republic even if they go out we will flag them and we are be able to know their movements.”

Mkhwanazi said that since the investigation began the number of suspects had grown and so had the evidence.

“I think it's a public knowledge that one of the firearms has been found which killed Mr Forbes and it is now in our possession. The getaway car that was used is in our possession.

“I must say although they (suspects) were found and people were arrested, those people were not necessarily charged in this murder case,” Mkhwanazi said.

“They are in custody. Are they involved with these ones? I'm not going to answer the question,” he said.

Mkhwanazi stressed that the police were working around the clock to put together a strong case for the prosecution team.

“I can give an assurance to South Africans that we are doing our level best and the picture is really matching. We are solving a 1000 piece [puzzle] and we are trying to get the shape together. It is quite a lot of work.”

Billionaire pleaded to pay Zambian Debts before re-possessing Mines

Anil Agarwal, billionaire and owner of Vedanta Resources Plc, looks on during a panel discussion on the opening day of the Investing in African Mining Indaba in Cape Town, South Africa, on Monday, Feb. 5, 2018. Mining executives, investors and government ministers are meeting in drought-hit Cape Town for the African Mining Indaba, the continent’s biggest gathering of one of its most vital industries.

(Bloomberg) -- Vedanta Resources Ltd. is ready to pay $250 million owed to suppliers in Zambia before the company resumes control of copper mines that were seized by the southern African nation’s government more than four years ago.

Former President Edgar Lungu’s administration placed Konkola Copper Mines under provisional liquidation in 2019, after accusing Anil Agarwal’s Vedanta of lying about expansion plans and paying too little tax. That sparked a series of court cases, culminating in current President Hakainde Hichilema seeking to resolve the dispute amicably.

Agarwal, who is looking to reduce the parent company’s massive debt load, has also pledged to invest $1 billion in Konkola and more than double copper production from the operation. Zambia’s output of the metal for 2023 is forecast to plunge to the lowest in 14 years. The industry is in dire need of fresh investment to take advantage of surging demand for copper to fuel the transition to clean energy.

The plan to pay all creditors is “to make sure I win the hearts of the people,” billionaire Agarwal said in an interview at Bloomberg’s Johannesburg office on Wednesday. “Money will never be a constraint.”

Vedanta has about $2 billion of bonds due in 2024 — a record annual bill for the company, with a $1.1 billion repayment due in January.

For Zambia, raising output at the mine will help it boost tax revenues in a nation that relies on the metal for about 70% of export earnings.

Konkola’s complexes comprise of shafts, a smelter and a refinery. It currently produces about 50,000 metric tons of finished copper from its own mines. First Quantum Minerals Ltd. copper mines in the country produced 390,000 tons last year.

Vedanta, India’s biggest mining company, produces metals from aluminum to zinc. It has also expanded its operations in Africa, and has mines in Namibia as well as South Africa.

“Africa is my heart,” Agarwal said. “If I have to marry two wives, one will be India, one will be Africa.”

Other key comments from the interview:Vedanta is considering selling its steel asset for as much as $7 billion because “either we should be number one or number two or we should not be in the business.”
Vedanta is fully committed to its semiconductor foray in India, is in talks with three potential partners and will announce a deal in a month or two. The company had earlier tied up with Hon Hai Technology Group but the Taiwanese firm parted ways with Vedanta in July.

Kasanda threatens to spill the beans over gold scandal

Kasanda spill the beans

Detained gold dealer Shadreck Kasanda has threatened to implicate State House if he is not immediately released from police cells.

Kasanda was arrested last Thursday in connection with a fake gold deal that unfolded at the Kenneth Kaunda International Airport over a week ago.

But in a latest twist of drama, Kasanda is now blackmailing the State to let him go or he will 'spill the beans'.

He said he will not accept to be a stooge in the scandal and preserve the honor of influential plot one employees, when he was only trying to be a responsible whistle-blower.

Kasanda’s lawyers Makebi Zulu advocates have written a letter to the Attorney General over President Hakainde Hichilema’s commentary on the unearthed gold scam at the Airport on August 14.

Kasanda and his co-accused Mahogany Air proprietor Dr Jim Belemu, his employee Patrick Kawanu and ZamQlik solutions limited director Oswald Diangamo are facing a charge of disposing minerals suspected to be proceeds of crime.

According to the Letter Makebi Zulu advocates stated that the President commented on the criminal activities at the the airport and drew conclusions prejudicial to Kasanda having a fair trial, when he was cognisant of the judicial process.

Kasanda’s advocates said the President's comment is honored and his sentiments cannot be taken lightly.

They claimed the decision by the State to  criminally pursue Kasanda is illegal in line with Section 43(1)(2)of the public interest disclosure (protection of whistleblowers).

Kasanda’s lawyers said DEC disregarded the disclosure made by the businessman to a security personnel after it joined the investigations midway and has gone on a tagnet issuing media statements suggesting that the disclosure was inconsequential and deemed Kasanda not to have been a whistleblower.

They stated that arresting Kasanda to the exclusion of named persons behind the whole deal who include known personnel at State house who after the ordeal accompanied the President to Angola is unjust.

“Upon returning from Angola the said officials have not been interrogated or arrested,”Kasanda’s lawyers stated.

“It is our demand that the State drops the charges forthwith and release our client from unlawful detention, failing which we shall be left with no option but to commence proceedings for appropriate remedies which action shall contain full disclosure of the information.”

They proposed that since Kasanda is ‘clean’ as the late KK’s handkerchief and snitched on State house officials in good faith the State ought to have made him their witness.

“Instead the public humiliation and victimization of our client have characterized the conduct of the State in an attempt to render him a scapegoat for matters well within the State's knowledge,” said Kasanda’s lawyers.

“Our client shall where appropriate report the known breach of the law and maladministration by the DEC to the public protector for investigations.”

Gold scam case dismissed due to lack of Evidence enough

Gold scam case dismissed

FOUR foreigners in the gold scam case have submitted in the Lusaka High Court that investigative wings warned and captioned them for allegedly giving false information to a public servant but from the time they were detained almost 10 days ago, they have not been formally charged.

The four, who were engaged as crew pilots for the seized private jet, have also complained that they have also not been taken to court, deeming the situation as an infringement on their rights.

They said this in an application before the Lusaka High Court in which they have applied for habeas corpus to that the court case assess the legality of their continued detention.

The four are Ali Abdulla Ali Al-Safi, a Saint Kitts and Nevis national resident in Egypt, Noha Salaheldin Aly Nadim, an Egyptian, David De La Cruz Castilla, a Spaniard national and Teunis De Mooij, a Spaniard.

According to court documents, the quartet is scheduled to appear before the Lusaka High Court for hearing of their application for habeas corpus after a Judge granted them an ex-parte application ordering the police to immediately take them to court for hearing of their application.

Through their lawyers, the four foreigners, have submitted in the High Court that they were engaged as a crew pilots in-flight service attendants by Flying Group Middle East FZCO, the operations and management company that runs the Bambardier Global XRS, serial No SN9159 and registration No. T7-WSS.

They say that on August 14, 2023, DEC officers and other investigators detained them at the Kenneth Kaunda International Airport (KKIA) on suspicion of, among others, money laundering.

They contend that their detention was on unfounded grounds.

Upon hearing of their detention at the KKIA, Flying Group Middle East FZCO engaged lawyers, Lungu Simwanza and Company and Andrew Musukwa and Company, to represent them.

They submit that on August 14 and 15, despite their numerous protests, the four were denied access to their lawyers and vice versa.

They complain that they were not provided access to basics like food and water at Chelstone police station where they are currently detained.

The four state that they were only allowed access to their lawyers last week Wednesday after being transported to the National Command Center, in Lusaka’s Sikanze Police Camp where they were held from 09:00hours to 23:00hours before being warned and cautioned for allegedly giving false information to a public servant.

They submit that the offence they were cautioned for is purportedly contrary to section 106(a) of the Penal Code Chapter 87 of the Laws of Zambia but argue that the section is non-existent as it has been repealed.

The four submit that investigators informed them that they cannot be released on bond until further notice because investigations are yet to be concluded.

Mr Al-Safi and others have accused the police at Chelstone of abusing their powers by declining to grant them bond considering that they have neither been changed nor taken to court from the time they were detained.

“Particulars of the matter are that Mugala, Kamanga and Mtonga jointly and whilst acting together with others unknown on dates unknown but between 1st March and 14th August 2023 stole 897 containers of septrin antibiotic tablets valued at K897, 000 the property of the Government of the Republic of Zambia which came into their possession by virtue of their employment as pharmacists at the Chipata District Health Office,” disclosed Khan.

He said the suspects are on bond and will appear in court soon.

“The Commission is concerned with the high incidents of theft of drugs from government health facilities. This practice is a clear and present danger to the health sector and the arrests of the three pharmacists is a clear demonstration of the Commission’s commitment to nip this trend in the bud and should send a message to others involved in this practice to desist forthwith,” he concluded.

“As an investigative agency of the State, the DEC will do its part to ensure that essential drugs meant for the Zambian people do not find their way into private pharmacies and wishes to inform members of the public that it has intensified its surveillance measures and will not hesitate to bring culprits to book.”

HICHILEMA IS A BOOK OF SCANDALS – KBF

…as he tears UPND’s two years in power to shreds

By Fox Reporter

ZAMBIA Must Prosper (ZMP) president Kelvin Bwalya has torn to shreds the performance of the UPND government in the last two years it has been in power as a “Book of Scandals”.

Speaking on Camnet TV’s popular State of the Nation live interview Monday night, Bwalya, popularly known as KBF, said the only success the New Dawn government had scored so far was making good-sounding pronouncements for which it would get a distinction.

The programme was reviewing the New Dawn government’s achievements and failures since it took over power in 2021.

Bwalya reeled out a litany of scandals ranging from the failure to bring down the cost of living to the shambolic handling of the agriculture, health and mining sectors.

“If we assessed the UPND’s performance in the last two years based on pronouncements, they would get a distinction. But on achievements, they’ve done nothing to improve the lives of Zambians,” he said.

“There are no achievements. What I see is only a book of scandals. They don’t care about the poor. They’re looking for everything and everyone to blame for their failures. It’s a scandal,” Bwalya said.

He described President Hakainde Hichilema as a liar who had promised Zambians heaven on earth but had failed to fulfill all the promises he had made while in opposition.

He cited the emptying of the sheds housing national strategic food reserves, failure to procure essential medicines and medical supplies, single sourcing of fertiliser, theft of sugilite and gold, firing and employment of citizens in the public service on the basis of tribe and region as some of the long list of the failures of the UPND government, which he described as scandals.

Bwalya also decried President Hichilema’s “endless foreign trips” to go and sign mere pledges at a great cost to the nation.

He promised Zambians that ZMP was coming in 2026 to provide leadership that would put their interests first, unlike the UPND which loved foreigners more than its own people.

The UPND will this week be celebrating its two years in power after winning the elections in August 2021.

Hichilema Orders Police To Transfer Me To Serenje- Fred M’membe

fred mmembe police

HICHILEMA ORDERS POLICE TO TRANSFER ME TO SERENJE

We have been reliably informed that Mr Hichilema has ordered the Zambia Police Service to transfer me to Serenje District in Central Province.

Mr Hichilema has insisted that I should be taken to Serenje before sunset today.

Subsequently, the Police high- command are currently making plans for my immediate movement to Serenje as instructed by Mr. Hichilema.

Just as I said a few days ago, the so-called invitation to appear at Ibex Hill Police station was nothing but a false display.

Ever since the Serenje incident occurred about four months ago, the Police have failed to find something on me and subsequently charge and arrest me given that there hasn’t been any basis to justify such an action.

But due to excessive pressure from Mr Hichilema, the Police command last Saturday, dispatched a team to Choma to get a statement from a UPND cadre they claim was injured on the head.

These desperate manoeuvres by Mr Hichilema only reveal that he is still politically immature to preside over a thriving multiparty democracy like Zambia.

It also shows that Mr Hichilema is an autocrat who is only prepared to govern a country where all opposition political parties and government critics are obedient praise singers.

But it shall not happen. The Zambian people shall not allow it. Like we keep saying, trumped- up charges or not against us; we are resolved to thwart his plans to make this country a sham multiparty democracy.

Why is Mr Hichilema so narrow- minded? Why is he so delicate? Why is he so afraid of criticism? Why does he want to be idolised?

Let Mr Hichilema know that the new Zambia he envisions, where he is more or less like an emperor or sovereign, and the citizens, his subjects to be governed by decree, will never happen.

We are ready to fight his tyranny!

Gold scam pilot demands release from detention

PILOT Patrick Kawanu who is in detention at Kabwata Police Station in connection with last week’s gold scam has asked the Lusaka High Court to compel the Drug Enforcement Commission (DEC) to release him from the filthy police cells.

Kawanu who is an employee of Mahogany Air, said the offence of giving false information to public officer which he stands charged is bailable hence there’s in no need for the police to have him under their watch after 48 hours when he has sureties lined up to secure his release.

In an affidavit in support of ex-parte notice of motion for writ of Habeas Corpus Ad Subjiciendum sworn Bwalya Nachimba of J and M Advocates, the pilot said the unreasonable delay in granting him bond and his continuous detention is unreasonable and unconditional.

“Kawanu is being held in an unsanitary, poorly ventilated and very crowded police cell at Kabwata police station despite the offense being bondable,”Nachimba said.

She said the Police and DEC have not given a valid reason for the continued detention of Kawanu on a bailable charge despite the sureties being ready to secure his release.

“It is for this reason that we crave the Court’s indulgence to order the respondents to produce the applicant before it so that they can show cause why he is being held in detention on bondable and bailable charges,”said Nachimba.

“I respectfully apply on behalf of the applicant to this Court to issue forthwith a writ directing the officer in-charge and others who may have control of Kawanu at Kabwata police station or any other police station that the applicant may be moved to have the applicant’s body before this Court after receipt of such writ to undergo and receive all and singular such matters and things this Court Shall then and there consider of and concerning the applicant on his behalf.”

Kawanu who is jointly charged with his boss Dr Jim Belemu the proprietor of Mahogany Air and representative of South Africa’s MTF, Oswald Diangamo and Shadreck Kasanda could not be arraigned before the Lusaka Magistrate’s Court today as prosecutors are attending a capacity building workshop in Livingstone.

The quartet who appeared before Lusaka chief resident magistrate Davies Chibwili last week Friday could not be tried in relation to their frustrated gold scam involving US$5.7 million.

The State was awaiting to indict the four together with the Egyptians who had requested to seek medical attention.

The Egyptians are identified as Micheal Botros, Walid Abelsayed, Yasser Elshishtawy, Mounir Gerges Awad, Mohamed Gouda, Tennis Demooiy, Del-a Cruse Castilla, Ali Abdull, and Noha Nadim.

The 13 were cornered by the Drug Enforcement Commission on August 14, 2023 following intelligence information that they were about to strike a dubious deal involving 602 ‘fake’ gold bars weighing 127.2 Kg.

In another incident a carrier smuggling 1,200 grams of gold chain also arrested

Officials of the Directorate of Revenue Intelligence (DRI) nabbed a 40-year-old Zambian national at the Kempegowda International Airport (KIA) and recovered 1 kg of cocaine worth ₹15 crore.

Officials of the Directorate of Revenue Intelligence (DRI) nabbed a 40-year-old Zambian national at the Kempegowda International Airport (KIA) and recovered 1 kg of cocaine worth ₹15 crore from him on Wednesday.

The accused was carrying the drugs concealed in a children’s book, which he was holding, and waiting for luggage clearance. While analysing the profiles of the passengers, the officials on a suspicion zeroed in on the accused and kept a close watch on him. The officials noticed the accused was carrying the nursery rhymes book with him and took him into custody.

The book was heavier than usual and the officials removed the cover to find half a kilo of cocaine packed neatly on each side of the cover. The accused confessed that he was unemployed and was offered money to carry the parcel to Delhi via Bengaluru.

He was given free tickets and a boarding and lodging facility from his handler in Addis Ababa from where he boarded the flight on a tourist visa, a senior official said.

The accused was asked to take a domestic flight to Delhi from Bengaluru and was given a code to share with the person who would come to receive him at the airport before handing over the book.

The accused has been booked under the Narcotic Drugs and Psychotropic Substances Act, 1985 and further investigation is on to track down others in the network, the official added.

In another incident, the officials caught a man and recovered undeclared 1,200 grams of gold chain worth ₹74 lakh which he had concealed in a pocket. The accused was caught by DRI officials as soon as he landed at KIA from Dubai. Inquiries revealed that he is from Chennai and went to Dubai to look for a job.

The officials suspect that he is a carrier and part of a gold-smuggling racket, which is being probed.

Congolese Man Marries 3 Sisters, Triplets. Here is why.

 Congolese Man Marries 3 Sisters

A Congolese man named Luwizo has gotten married to triplets after the sisters insisted on him marrying all of them at once. The unusual wedding ceremony took place in Kinshasa, the capital of the Democratic Republic of the Congo, on Saturday, April 19, 2023.

Luwizo, a 32-year-old businessman, met the triplets—Nana, Nene, and Nini—at a local market, where they were selling fruits and vegetables. He was immediately attracted to their beauty and charm and decided to approach them. He soon found out that they were identical sisters, born on the same day and hour.

He asked for Nana's phone number, but she refused to give it to him unless he also took the numbers of her sisters. Luwizo agreed, thinking that he would only call Nana later. However, he was surprised when all three sisters called him back and demanded that he date them all together.

Luwizo was reluctant at first, but he soon fell in love with the triplets' personalities and sense of humour. He also enjoyed spending time with them as a group, as they shared many interests and hobbies. He decided to propose to Nana, but she told him that he had to marry all three of them or none of them.

Luwizo was shocked by this request, as he knew that polygamy was illegal in the Democratic Republic of the Congo. He tried to convince the sisters to change their minds, but they were adamant that they wanted to share him as their husband. They said that they had always done everything together since they were born and that they could not imagine living apart from each other or from him.

Luwizo consulted his family and friends, who advised him against marrying the triplets. They warned him that he would face legal and social consequences for breaking the law and the norms. They also questioned how he would be able to afford and satisfy three wives at once.

However, Luwizo was determined to follow his heart and make the triplets happy. He said that he loved them equally and that he was ready to face any challenges that might arise from their unconventional marriage. He also said that he had enough money and resources to support his large family.

He arranged for a traditional wedding ceremony with the consent of the triplets' parents, who were also supportive of their daughters' decision. The ceremony was attended by hundreds of guests, who were curious and amazed by the sight of the groom and his three identical brides. The brides wore matching white dresses and veils, while the groom wore a blue suit.

The wedding was officiated by a local chief, who blessed the union and gave his approval. He said that he respected the choice of the couple and that he hoped that they would live happily ever after. He also said that he did not care about the legal ban on polygamy, as he believed that it was a part of traditional culture.

The newlyweds said that they were overjoyed by their wedding and that they looked forward to starting their lives together as a family. They said that they planned to have children soon and that they hoped to have more triplets or quadruplets. They also said that they did not care about what other people thought or said about them as long as they had each other's love and support.

Japan online Car Buying Scams Increases For Zambia.

THERE is an increase in cases involving motor vehicle fraud of used Japanese vehicles being imported in Zambia, Zambia’s Ambassador to Japan Tobias Mulimbika has said.

Dr Mulimbika said it is concerning that Zambians have continued to lose large sums of money in such a manner.

He has implored potential buyers to conduct thorough due diligence of motor vehicle sellers before making online payments to avoid losing huge sums of money.

“The Zambian Embassy in Tokyo has recorded an increase in the number of such cases and has attributed the vice to lack of Information.

Let people verify details of the sellers to avoid being scammed. It is very difficult to recover the money as most of the purported sellers may not have a verified physical address in Japan and operated off-shore”, he said.

Dr Mulimbika said the Embassy should be contacted for verification purposes before making payments unlike after a person has been a victim of fraud.

“Citizens should always conduct online motor purchases through reputable companies that are traceable,” he advised.

He further urged prospective buyers to always check with the Japan Used Motor Vehicles Exporters Association (JUMVEA),for some of the reputable and credible companies regulated by the Ministry of Economy , Trade and Industry of Japan.

Dr Mulimbika added that the Mission has continued to engage the Ministry of Foreign Affairs of Japan and Interpol on how best such cases may be addressed to promote trade between the two countries.

This is according to a statement issued by the Republic of Zambia in Tokyo Japan, first Secretary to Press and Public Relations Faith Nabeene Chilube.

GOLD SCANDAL: Two chartered private jets, a Bombardier Global Express, BD-T7-700-1A10 (T-WSS) and Bombardier 6000, HB-JLC, arrived in Lusaka on 13th and 14th August 2023- Amb. Emmanuel Mwamba

The mystery of the plane that left-Seeking answers,

●…Two chartered private jets, a Bombardier Global Express, BD-T7-700-1A10 (T-WSS) and Bombardier 6000, HB-JLC, arrived in Lusaka on 13th and 14th August 2023…

●….one came from Amman, Jordan and the other came from Geneva, Switzerland….

●….Kenneth Kaunda International Airport has ultra-modern CCTV camera system that covers the perimeters of runways, landing jets, apron, outside car parks and terminals and will likely confirm the details….

Asking uncomfortable questions

The Drug Enforcement Commission Director General Nason Banda, announced that they had seized millions of dollars, guns, and suspected gold in the multi million gold scam that occurred at Kenneth Kaunda International Airport (KKIA).

Mr. Banda also announced that the Commission had seized a foreign private jet plane, a Bombardier Global Express with registration no. T7-WW and a local plane.

We have since established that the details of the plane given by the Director General is totally different from the one journalists were shown at the KKIA apron two days later.

Journalists were shown a Bombardier Global Express,T7-WSS. The T7-WW may actually not exist and there is a possibility that the DEC details could have been as a result of a typo error.

However, the T7-WSS plane can be tracked and its flight path from Jordan-to-Cairo-to-Lusaka has now been established.

The Boambardier Global Express(GLEX) or T7-WSS left Amman, Jordan, at 20:09 and arrived in Cairo, Egypt, at 21:55 UTC on August 12, 2023. It left Cairo to Lusaka and arrived in Lusaka on Sunday 13th August 2023 at 18;15hrs, local time.

The 19-year-old private jet Global Express-BD-700-1A10 , T-WSS is operated by Malta-based, Hyperion Aviation.

The jet is registered in San Marino, a landlocked country and enclave in Italy also known for its offshore and tax haven activities.

DEC said the local plane was a King Air with registration no. B190.

This plane belongs to Zambia Skyways. Zambia Skyways is owned by Mr.Yousuf Zumla who is also Tourism Council of Zambia Chairperson.

On Tuesday, reports and videos emerged that the plane had left, a matter that caused pain and public anxiety.

However, the Minister of Home Affairs Jack Mwiimbu assured the nation on Wednesday that the suspects, the Gold, and the millions of dollars were in law enforcement agencies’ custody.

THE SECOND PLANE

However irrefutable flight path information has now emerged that a second plane is also involved and could be operated by the same Executive Hire agency as the T7-WSS.

A Bombardier 6000 GLEX, an ultra long range, high speed corporate jet, took the similar flight path during the same period.

This particular plane now identified by its registration no. HB-JLC, flew from Geneva to Addis Ababa on 13th August 2023. It then flew to Berbera Somalia on 14th August 2023.

The HB-JLC arrived in Lusaka on Monday 14th August 2023 at 17;53.

On Wednesday, 16th August 2023 the plane left Lusaka to Zanzibar at 08;33hrs. This is the day of the swirling rumor and video that the plane that is under investigations had left.

This Bomabrdier Global 6000 aircraft flies under the tail number HB-JLC and is operated by D-Jet (Operated by: Nomad Aviation AG), this is fairly a brand new plane built in 2019 by Bombardier as part of their Global 6000 series.

This Bombardier Global Express HB-JLC is based and operates from Geneva Airport (LSGG).

CONCLUSION

From the above details, it is without doubt that we have two planes that arrived in Lusaka on Sunday 13th August 2023 and Monday, 14th August 2023.

There is a Bombardier Global Express, BD-T7-700-1A10 (T-WSS) and a Bombardier Global 6000, (HB-JLC).

Flight details and search will lead you to operators; Swiss Private Jet, Nomad Aviation and Hyperion Aviation that seem to share similar fleet of planes and the companies are registered in various jurisdictions.

Government has a sacred duty to inform Zambians of the truth because of the scale of this scandal and law enforcement agencies and other persons should not be involved in committing more crimes after the initial crimes by covering up.

Zambia is privileged that it has an ultra modern international airport with CCTV system that should be able to confirm these details.

We ask uncomfortable questions to help establish the truth.

Gold Scam Suspects Gets Sick.

SOME of the 13 suspects apprehended in connection with the trending ‘gold scam’ are reported to have fallen sick and are seeking medical attention.

Only four of the 13 appeared in court yesterday in connection with charges, among them corruption related.

Lusaka businessman Shadreck Kasanda was among the four suspects who appeared in court yesterday for mention of their court case.

After the matter was called before Lusaka chief resident magistrate Davies Chibwili, the court was informed that only four were before court.

Those present were Kasanda, Jim Belemu and Mulungu Diangamo and Patrick Kawanu.

The prosecution team informed the court that other nine suspects in the case have not been formally charged.

At this point, the defence team raised in issue with the indictment and contended that matters been raised should not be addressed in an open gallery.

Magistrate Chibwili then ordered that the parties meet in chambers.

Afterwards, defence lawyer Martha Mushipe informed a horde of journalists outside that the court not proceed with the matter because of some procedural impropriety in the matter following absence of some of the accused.

She also disclosed that some of the suspects who were not present in court are sick.

“Apparently, it appears the Egyptians have been taken to the hospital, apparently some of them are not unwell, they have been allowed access to medical facility,” Ms Mushipe said.

The Drug Enforcement Commission recently arrested the 13 in connection with a gold scam case resulting in a seizure of guns, rounds of ammunition, US$5million, fake 127kilogranmes gold and a place on which the items were found.
